Hosting and Maintenance Agreement for Fitness320

By purchasing the subscription below, Fitness320 (“Client”) has enters the following agreement with Matthew Jones (“Service Provider”) to proceed with web hosting and maintenance services for an ongoing period starting March 1, 2021 and agrees to the terms and conditions set forth in this Agreement.

OPTION 1: Hosting and Maintenance only:

Under this Agreement, Service Provider will provide hosting, maintenance, updates, and site support required to keep your site up, running, and healthy. This includes plugin updates, secure site hosting, SSL encryption, and daily backups.

Payment for these services will be to the Service Provider at the rate of $149 per month and will be made for the following month no later than the 30th day of each month that this agreement is in force. No invoice will be submitted.

Any development or consulting services provided in addition outside of the Description of Services will be made available by Service Provider at a separate project fee and will be billed separately.

Description of Services:

  • Provide daily site backups
  • Maintain all WordPress plugins
  • Manage PHP version updates
  • Manage WordPress core updates
  • Provide and ongoing hosting solution
  • Provide end-to-end SSL encryption

All materials furnished by Client will remain property of Client and will be returned upon request, or no more than 30 days from termination of this agreement.

The results of any and all work performed by Service Provider for Client, including original creative work, will remain property of the Client. Client may use this material in any way deemed appropriate.

This agreement may be terminated on 30 days’ written notice by either Service Provider or Client. In case of termination, Service Provider shall make a reasonable attempt to finish work in progress.

In addition to these terms, Client may choose ONE (or none) of the options below to retain ongoing technical advice and service:

OPTION 2: Hosting and Maintenance + Hourly On-Call

In addition to the $149 monthly hosting plan, this option allows Client to obtain technical support at an hourly rate of $65. With this option, Client only pays for technical support that is used. Any communication that can be considered technical in nature will be billed as consulting. Any changes or additions to the existing site’s functionality or design will also be billed under this option. Client cannot have more than one unpaid invoice at a time. No new hourly work or consulting will be provided if Client has an unpaid invoice for previous hourly work.

OPTION 3: Hosting and Maintenance + Monthly retainer

In addition to the $149 monthly hosting plan, this option allows Client to retain 30 hours per month from Service Provider at the hourly rate of $45. With this option, Client prepays for 30 hours of support each month, regardless how much support is used. If support exceeds 30 hours in a single month, the time beyond 30 will be billed at the hourly rate of $65. This option will be rolled into the monthly hosting and maintenance plan for a total of $1,500 per month.
